Samsung asking for new trial, Apple asking for higher damages
The recent jury decision against Samsung last month for over $1 billion sent shock waves throughout the world. That is partly because while Apple was found to have violated Samsung patents, they did not have to pay any damages. That did not seem right and as a result, Samsung is asking the court to set aside the verdict and conduct a new trial. Apple is asking for another $707 billing in damages which seems extremely and they want to expand the products to be banned here in the US. In some respects, it seems that this is never going to end.
It seems that Samsung and Apple continue their war this year in the courts. And Samsung may sue Apple over LTE and if they do, it is going to make things very interesting. They could attempt to ban the iPhone 5, but that is unlikely, just as it is unlikely that Apple will get a ban on the Galaxy S3. These battles are hurting both companies. Samsung has renewed their ads going after those standing in line for the iPhone with features that already exist on the Galaxy S3 and not on the iPhone 5. These two are fighting for each and every sale. At some point, these fights have to end as the only winners in the lawsuits will be the lawyers.
In spite of all this, Samsung continues making chips for Apple with the A6. And that makes for strange bedfellows given the battles between the two companies. Previous reports had Apple moving away from using Samsung for chips, but this proof shows they are still in business together.
The big question on many people’s minds right now is whether Samsung can maintain sales with the release of the iPhone 5 and the publicity from the lawsuit. Only time will answer that question. We would like to see the Galaxy S3 hold its own in the competition with the iPhone. We would also like to see the jury decision between Apple and Samsung thrown out and the new trial be moved to a jurisdiction outside of California. If only wishes like these could come true.
