Opening statements begin in the morning between the parties.
The trial here in Northern California is preparing to start with opening statements tomorrow morning. That was after they were able to seat a jury of 10 on the first day. It was expected it would possible take 2 days because of the San Jose location for the trial. With Apple close by, most are very much aware of Apple and Steve Jobs. Finding an impartial jury so quickly is a surprise. With that in place, lawyers for both sides can begin with the opening statements.
This trial is expected to last less than 4 weeks and have a decision completed by September. There are those who are questioning whether an impartial jury can be found, it does appear one has been selected which the various parties agree with. The outcome of this case rests with the 10 who have been selected. Both Apple and Samsung have much as stake and much to lose with this case. And you have to remember that they are also partners in other activities. Being called as frenemies by some, Samsung supplies components for the iPad and iPhone. This must make for strained relations between the 2 companies as a result.
While this case may be concluded as soon as August 17th, it will take the jury some time to review all the presented material and attempt to make their decision. And it is a difficult decision to be made. Lawyers on both sides have put out their information to support their case as well as putting out information to cloud some of the issues. That creates challenges for the jury to wade through all of the coming information they are going to see and hear. And in the end, the decision they make will cost one company billions of dollars payable to the other.
This is going to be watched by many as to the impact to the industry. If Apple wins this case, it will give them more precedent to go after others they believe have copied their patents. And that includes Google who has created the software to run so many mobile devices. We all know who ever loses this will be appealing the decision. But the decision from this case will have a big impact on the industry as a whole.
